Welcome to Storywhisk. These Terms of Service ("Terms") are a legal agreement between you and Storywhisk ("we," "us," "our") governing your use of storywhisk.com and our personalized children's storybook service (the "Service"). By using the Service or placing an order, you agree to these Terms.
You must be at least 18 years old to use the Service and to make a purchase. If you upload a photo or details of a child, you confirm that you are that child's parent or legal guardian, or that you have the parent's or guardian's permission, and that you consent to our use of that content to create the book.
Storywhisk creates personalized, AI-illustrated digital children's storybooks. You provide a photo and a few details; we generate a storybook starring your child, delivered as a digital file (PDF). We also offer the Storybook Club, an optional monthly membership that includes a new story each month and member offers.
You are responsible for the accuracy of the information you provide and for keeping your account secure. Notify us at hello@storywhisk.com of any unauthorized use.
Prices are shown at checkout and may change over time. Payments are processed securely by Stripe; by purchasing, you authorize the applicable charge. Our products are digital and delivered electronically. Taxes may apply based on your location.
The Storybook Club is billed monthly until cancelled. You can cancel anytime, and you'll keep access through the end of your current paid period; we don't charge you again after you cancel. See our Refund Policy for details.
You keep ownership of the photos and details you upload ("Your Content"). You grant Storywhisk a limited, revocable license to use Your Content solely to create, produce, and deliver your storybook and to provide the Service to you. You represent that you have the rights and permissions to upload Your Content (including any photo of a child) and that it does not violate any law or third-party right. Do not upload content that is unlawful, harmful, or that depicts a person without authorization.
We and our licensors own the Service, our story templates, characters, software, and brand. When your book is complete, we grant you a personal, non-exclusive license to enjoy, print at home, and share your finished storybook for personal, non-commercial use. You may not resell, mass-produce, or commercially distribute our templates or your generated book.
Illustrations are produced by AI and are an artistic interpretation of the photo you provide. Results vary and may not perfectly match the original. If you're not happy with your book, contact us and we'll work to make it right (see Refunds).
You agree not to misuse the Service, including by attempting to disrupt it, reverse-engineer it, scrape it, infringe others' rights, or upload prohibited content. We may suspend or terminate accounts that violate these Terms.
The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Storywhisk will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. You agree to indemnify Storywhisk against claims arising from your misuse of the Service or breach of these Terms.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.
